The working agreement between TKV Creatographics and our clients, covering scope, payment, ownership, support and how we handle the small print together.

Contract

When clients approve work to commence, it establishes a binding agreement. Approval may be given through either an email confirming back the quote (with the quote document attached) or the quote document signed by the client. TKV Creatographics operates in IT services, producing websites, graphic designs and creative works.

Important

Payment of the advance fee indicates that the client accepts these terms and conditions, and approves to commence the work.

Clients agree not to use our services for illegal, harmful or child-endangering businesses. Clients bear full responsibility for all content published through their websites, whether hosted by us or independently.

2 months of free technical support

We provide free technical support for:

• Server-side scripting / programming errors or bugs
• Logical bugs or calculation-related errors
• Connection errors or API integration errors

Support excludes issues from external entities, including:

• Server, software, application or extension downgrades / upgrades
• Operating system or browser version downgrades / upgrades

Support is unavailable for:

• General feature inquiries
• Cosmetic or UI / UX updates
• Feature enhancements or modifications

Exclusions from free support

These exclusions apply: full-time engagements, direct client team collaboration and installation-only projects.

Photography and graphics

Stock images used in promotional materials are not included in deliverables unless purchased separately by clients. We may use stock photographs, separately invoiced. Clients must purchase usage rights and cannot use demo images commercially without authorization.

Browser compatibility

TKV Creatographics makes every effort to design pages that work flawlessly on the most popular current browsers. We target the latest versions of Chrome, Safari, Edge and Firefox on desktop and mobile. Internet Explorer and other discontinued browsers are not supported.

Search engine submission

The following are not included unless explicitly agreed:

• Website submission to search engines
• Securing search engine rankings
• SEO optimisation services

Site maintenance

Unless agreed otherwise, these services are separately billed post-launch:

• Content updates
• Website refinements and tweaks
• Design and presentation updates

Content responsibility

After delivery, clients are solely responsible for website content. We will correct errors if reported.

Client-supplied material

All material supplied by the client shall remain the client’s property. We assume material does not breach copyright laws and bear no responsibility for claims arising from client-supplied materials.

Domain names booked by TKV Creatographics

Domain names registered by us remain our property until fully paid. We will transfer domains upon request once accounts settle. This applies only to domains booked by us, not client-owned domains.

Travel time and expenses

Travel time to client premises is not generally included. Clients bear travel expenses, or as mutually agreed.

Third-party add-ons / services

All third-party costs must be paid to us before registration. Examples include domain names, server hosting, SSL certificates, backup services, APIs, plugins and payment gateways.

Portfolio usage

Unless negotiated otherwise, TKV Creatographics retains the right to list and display the client’s name and logo, with or without work performed, in its respective portfolios and promotion materials.

Quotations

Quoted prices cover only agreed work. Additional changes require separate quotes and timeline review. Cost estimates and prices quoted are valid for a maximum of one month unless otherwise agreed.

Mode of payment

International clients

Wire transfers, credit cards or PayPal via 2Checkout.

India-based clients

UPI, NEFT, RTGS or physical cheques.

Other services require wire transfer only.

Payment terms

Payment plans follow agreed milestones. The payment shall be due within 14 days of the invoice date unless specifically mentioned in the invoice.

Full website publication occurs only after payment receipt. Unpublished material may be removed; restoration costs USD 150 minimum. Late payments incur USD 100 or 5% of invoice amount (whichever exceeds) weekly. Late payment exempts us from timeline commitments.

Cancellation

Both parties may cancel at any stage. Client cancellations result in refunds minus upfront project initialisation fees and completed milestone payments. Company cancellations refund amounts minus “$15 per hour for hours spent on the work performed”, including discussion, planning and execution. Upon settlement, we transfer all project documents, designs and scripts.

Penalty clause

Company penalties

We agree to complete projects within agreed timelines. Delays incur penalties of X% monthly on the original project price. If delays exceed 8 weeks, clients may request cancellation and a full refund, not exceeding the original price (excluding additional requirements). X% = 50 / project-duration weeks; X% cannot exceed 4% unless explicitly agreed. Penalties adjust against pending client payments. Full refunds mark projects cancelled; we retain all rights to work products. Clients using refunded work face liability for the full project price.

Client responsibilities

Clients must provide feedback within 24 hours of work submission. Delays in feedback exempt us from timeline penalties. Scope changes incur additional charges and timeline extensions. Non-payment exempts us from timelines.

Delayed client response

Unreasonable delays in providing required feedback exempt us from timelines. Non-response exceeding 5 working days authorises us to forfeit payments. Non-communication exceeding 10 calendar days deems the project received and accepted; we may invoice for remaining amounts.

Projects may be held if clients pay a “$100 or 30% of the total project price, whichever is higher” resumption fee, with a maximum 1-month hold. Hold periods may involve different project team members, and resumption fees apply each hold instance.

Escalation

First level

Email contact@tkvcreatographics.com for project timeline or manager dissatisfaction issues; expect a response within 3 working days.

Final level

If unsatisfied after 5 business days, escalate to CEO Vikramraja at contact@tkvcreatographics.com.

Time estimates

The client agrees that stipulated timelines cannot be met if the client changes the project scope once the project scope document is finalised. Each change requires a minimum 1-week timeline extension.

Profit sharing

After agreed payment, we waive claims to client business profits or sale proceeds.

Copyright & ownership rights

We retain copyright on all material created unless otherwise agreed in writing. Clients own rights to:

• Client-supplied logos, graphics or images
• Custom designs with exclusive rights
• Programming files / source code with exclusive rights
• Domain-licensed systems, allow use only on designated domains

Unless otherwise agreed, we own source code and intellectual property, reserving reuse rights for other projects.

Clients cannot create unauthorised copies, access, share or transfer our materials; reverse engineer software; or share works with third parties without explicit authorization. Breach authorises Indian or international courts to award compensation, attorney fees and costs. We may claim additional damages and pursue criminal proceedings. Clients using refunded work face liability for the full project price.

Termination

Upon agreement termination, both parties continue fulfilling respective obligations.

Notes

We bear no liability for damages, lost profits or consequential harm from website operation or errors. We correct errors only; accuracy is not guaranteed. Individual waivers don’t affect remaining clause validity. Statutory rights remain unaffected. We reserve amendment rights; prior signed agreements remain valid.
